Close call - minor accident

Stupid lady was looking down into her lap at her phone and drifted right into me while I was in the carpool lane. I slammed on the front brake to try and escape (too high a gear to accelerate out of the way) but she still ended up hitting me with the left side of her car behind the rear wheel. I accidentally locked the front wheel up and she hit me while it was locked up, the front wheel swished around. I kept the bike up though, I knew if I went down it'd be really bad news. Super close call though. Right afterwards, I look at her in her car and she looks back at me as if she has no idea what was going on. She then proceeded to just keep driving, So I started yelling and pointing for her to get over while forcing her to the right with my bike. When she finally pulls over in a gas station, she gets out and asks "why did you hit me?"
I responded by saying "You were on your fcking phone and could have killed me."
She goes, "Why are you looking at me like that, Im calling the cops"
Me, "Call the ****ing cops"
(I was giving her some serious death stare)

CHP dude gets there, takes my statement in like 2 minutes, then proceeds to talk with the lady for a good 15 minutes. Idk what was being said but they were both smiling a lot, laughing together, etc. I couldn't believe it. I feel like this bitch is going to somehow get me at fault for her bullshit.

All that made contact was my frame slider, it's bent pretty badly.

There is old damage on her car right above where she hit my slider. Looks like shes trying to use me to take care of an old issue.

Considering CHP has fcked me over in the past on an accident, I'm really worried. With that damn wheelie ticket looming, and if I get put at fault for this BS, byebye license

WTF dude. That is some serious bullshit. I suppose you have no witnesses. Any chance of getting some surveillance footage?

I think, with the explanation you have above, any judge would see it was her fault. Why would any motorcycle rider deliberately ride into the side of a car?

My friend had similar situation, where woman keeps refusing her fault, where just before rammed him by side of her car. Luckily he managed to stay on the bike. This end up in court and my friend won, but he had witness.
I can only imagine your anger, especially right after, when you just realised how close it was. Hope this end in your favor, as I can't believe they would put you in fault in here. But... heard about many idiotic verdicts in the past, so I wouldn't be surprised.

I would check the Cal trans site. They have web cams all over the freeways. See if you can find one in the area the accident happened and maybe you can subpoena the footage.

With incidents like this becoming all too frequent due to drivers obsession with use their mobile phones whilst driving, the value of a camera on either machine or rider is looking like a sound evidential investment for next years outings.

Hope it turns out ok for you in this instance

Was on the FZ09, wouldn't have had braking troubles on the SD lol.

Was a middle-aged lady, not hot at all.

My GoPro that I usually ride with was full on memory and I decided not to clear it the night before...
