A motorist who a court heard opened his car door, causing a cyclist approaching from behind to be crushed by a bus, has been found not guilty of manslaughter. I guess murder has to be a deliberate premeditated act....

Manslaughter has to show intent ? "causing death by negligence...." is more likely what i would percieve it being.

At the end of the day... the driver wasn't aiming to kill someone, or even hurt them.... it's a sad set of circumstances that brought about a death.

IMO he should be punished for fitting the window tint that caused this ... but prison to me seems harsh ?

I like the quote from the father of the cyclist; "We're obviously very disappointed"

He was sure hoping to ruin another mans life because of negligence. I cannot imagine getting sent to prison for simply opening my door without checking first.

I was listening to this on the radio and the CPS want another law in that could cover this. If the engine had been running they could have done him for driving without due care and attention or dangerous driving but as it wasn't these options weren't available. It sits in a no mans land of law.

I have always been an advocate of a new law to be passed it would entail me saying "your under arrest for being a twat", the definition being "whilst not in your place of abode, do an act which any reasonable person would render himself to believe you have been or are a twat", this would come in very handy as it covers so much that the law dos not always cover (never seen it on an ASBO yet mind think they are missing a trick).

Sentence(s) can vary from a night in the cells to 12 years imprisonment, id lock up all the chavs for walking down the street with their hands down their pants (its an English thing) to this guy whom the thread is originated, no not you Schnauz.

I could maybe extent this statute to cover "being a no good twat" where you know someone is a twat and up to no good at 3am on a street where they dont live but you found nothing on them and they have committed no offences (yet).

I'm often on the side of the cyclist in discussions like these, i'm an avid cycler myself having done nearly 3000 miles this year (over double than my motorbike miles) and recently a chunk of that has been on the road. People are just oblivious to cyclists at times.

However this is just a sad case of wrong place wrong time.

No one seems to be mentioning that the cyclist was also at fault, tragically. One thing you don't do is ride close enough to parked or parking cars for that very reason..

I have to disagree with the use of the word "accident" an accident is an on-avoidable occurence. this guy & his "cool" tinted windows cost another man his life...this is not justice, it is an insult.
